I am submitting an open records request for any e-mail from Jim Graf (e-mail grafjjg@co.sheboygan.wi.us) pertaining to aldermanic or City of Sheboygan business that have been sent via that specific e-mail address from March 2005 to the present (July 2006). This EXCLUDES personal e-mails. I have listed some people who may have either received or sent e-mails regarding official business. This request is not limited to this list, but could include any e-mails regarding issues that pertain to duties performed as an alderman.

Possible recipients:
Mayor Juan Perez, Susan Hart, Mary Rajer, Adam Payne, Eldon Burg, Richard Manny, Bob Ryan, Renee Suscha, Jean Kittelson, Jim Bohren, Gene Davis, Jeanne Kliejunas Bonnie Cerda, Jeff Radtke, Mark Hanna, Vicky Meyer, Marilyn Montemayor, Silas Vander Weele, Lee Montemayor, Carter Pawlus or Ed Wackowski.

Again, this request is NOT for personal e-mails. It is only for those which would obviously be related to his duties as an alderman for the city of Sheboygan which would have been sent or received on his Sheboygan County e-mail account. The intent of this request is to follow the guidelines of the state of Wisconsin for open records requests involving elected officials.

I have already been in contact with both you and Mike Collard regarding this issue. Please feel free to refer this to anyone else you feel needs to be informed of this request. I would expect this to be responded to as soon as practicable.

I am submitting a second, different open records request for any e-mail from Jim Graf (e-mail grafjjg@co.sheboygan.wi.us) pertaining to aldermanic or City of Sheboygan business that have been sent via that specific e-mail address from March 2005 to May 31, 2006. This EXCLUDES personal e-mails. I have listed some people who may have either received or sent e-mails regarding official business.

I am requesting e-mails ONLY from, to or mentioning the following names:
Mayor Juan Perez, Adam Payne, Susan Hart, Renee Suscha, Marilyn Montemayor, Lee Montemayor, Carter Pawlus or Ed Wackowski or are regarding any or all of the topics “shared services, 23rd Street property, Van Der Vaart property or business, ACT 40, Building Use, Police Department”. Please notify me if the cost exceeds $30.00.

Investigation Request To D.A. DeCecco

August 9, 2006

Dear Mr. DeCecco,

Enclosed you will find e-mails that I requested via an Open Records request for Alderman Jim Graf. I believe there is reason to believe that Alderman Graf, along with other members of the Sheboygan City government have violated Wisconsin’s Open Meeting laws by “conducting business” via e-mail. You will find them sorted into various sections with notes pointing out which may be considered a violation or others that may violate other statutes.

There are two piles. The larger one, which I felt may not have any pertinent information, and the smaller one which has notes attached to make it easier to sort out. I believe that the smaller groups of e-mails may include several violations as they are sent to enough members to constituent either a quorum or a negative quorum.

Taken in its entirety, these represent only SOME of the city business that has been conducted by Alderman Graf while working for the County. Due to the expense involved, I limited my requests (see letters attached from the IS department) to include only select people or issues for the past year. However, it would appear that very much time was spent by Mr. Graf on city business while working in his capacity as a Sheboygan County employee.
