I have received your Open Records Request on May 31, 2006 for records concerning "The Mead County Library Board, Sheboygan Mayor's personal and office records, as well as all of Susan Hart's notes concerning Sharon Winkle's contract and/or agreement for employment, including billing and/or negotiations with Mary Lynn Donahue, changes to the Mead Library's budget, and ramifications to services due to budget changes."

The City Clerk does not have custody of any records pertaining to this request, however, I have received documents from the Finance Department /Nancy Buss and from the Mayor's Office/Susan Hart. There are 5 pages at a cost of 25 cents per page ($1.25) . I will have them in my office if you wish to pick them up.

Re:      Your Open Records Request Dear Mrs. Tuszynski:

This is in reply to your request, dated July 10, 2006 which was hand delivered to our office on July 12, 2006, for copies of the following records:

"The Library director's contract or employment agreement and any notes, e-mail, minutes pertaining to this issue or in relationship to the library board or any of it's members. This is a request for information to all issues surrounding the negotiation of, discussion of and ramifications of Sharon Winkel's employment as library director or its effect on the Mead Library or its employees."

I have identified approximately 362 pages worth of materials that are responsive to your request, and which I offer to make available to you. As to 6 pages of e-mails and 2 pages of handwritten notes, I am denying your request. These e-mails are exempt from disclosure under sec. 19.36(1) of the Wisconsin Statutes as attorney-client privileged communications. My notes are exempt from disclosure under sec. 19.36(1), Wis. Stats., as attorney work product.

Please note that my decision, insofar as it constitutes a partial denial of your open record request, is subject to review by mandamus under sec. 19.37(1), Wis. Stats., or upon application to the Attorney General or District Attorney,

With respect to two of your public records requests dated June 27, 2006, regarding the meeting with Firefighter Wally Endsley in 2005 and the meeting with SCO Jack Gebler in May of 2005, the Mayor's office has no records that correspond to your request.

I have attached the records responsive to your public records requests, one dated June 28, 2006 requesting records concerning "the proposed police station building.... e-mails involving Mike Leibham received on June 27" and the records responsive to your other public records request dated June 27 requesting records of "a meeting with Officer John Winter held in the Mayor's office in May or June 2006....".
