Hello Mayor Perez-

At last night's (11/21) meeting of the Common Council the above referenced document was referred to both the Library Board and the Common Council Finance Committee. I have attached the document for your ease of reference.

Please be aware that my recommendation to the Library Board at its meeting of December 15 in response to the concerns set forth re Sec. 58.31 Composition and 58.33 Terms will be to refer Mr. Henry Capetillo to the Office of the Mayor.

Sec. 58.31

The Mayor is the appointing authority for Library Board members. Mayor Schramm appointed Francha Barnard as the SASD representative to the Library Board in the role of the Superintendent's designee per state statue and City of Sheboygan Municipal Code. The Library Board was in no way responsible for the selection or appointment of this Library Trustee nor is it responsible for filing communications from the Superintendent pertaining to his designee. Ms. Barnard is not an ex-teacher as characterized by Mr. Capetillo. She retired from her position as a Library Media Center Specialist earlier this year and continues her association with SASD as an on-call substitute.

Sec. 58-33

As the appointing authority, the Office of the Mayor is responsible for designating the 3-year terms to which Library Trustees are appointed. Please note that there is no reference in Sec. 58-33 to the number of terms expiring or to be appointed in a given year. This section specifies the length of each term - 3 years. Sec. 58-31 specifies the number of Library Trustees.

In response to Mr. Capetillo's remarks to the Library Board at its meeting of October 27, the Library Board reviewed draft revisions to selected sections of Chapter 58 Libraries at its next meeting -November 17. This is the most expeditious response possible short of calling a special meeting of the Library Board.

At that meeting the Library Board determined to hold action on the draft revisions pending the availability of information from Finance Director Rich Gebhart who wishes to consult with the City's new auditing firm, Schenck, prior to finalizing his review of the recommended revisions. The City Clerk and City Attorney have already reviewed and approved the recommended revisions from their perspectives, with the City Attorney noting the key role of the Finance Director in reviewing them.
